DiVita Creative Terms of Service

Last updated: October 29, 2026

The short version

  • Flat pricing, paid in full at booking. No surprise invoices.
  • Card or Klarna at checkout, through Stripe.
  • Full refund if you cancel before work begins. After that, payments aren't refundable.
  • When your site is done and paid for, you own the finished site and files.
  • You're responsible for the content you give me.
  • Care Plans are monthly or prepaid yearly, with no long contracts.
  • New York law applies.

These terms are an agreement between you and DiVita Creative LLC, owned by Tina DiVita in Rochester, NY. "I," "we," and "us" mean DiVita Creative. "You" means the person or business using the site or buying a service. By using https://divitacreative.com or buying a service, you agree to these terms. If you don't agree, please don't use the site or services.

You must be at least 18 and able to enter into a binding agreement to buy a service. If you're buying for a business, you confirm you're allowed to agree on its behalf.

Your signed contract comes first. Every website project also has a signed contract. If your signed contract says something different from these terms, the signed contract wins.

Services and pricing

ServicePrice
Single-Page Website$600 flat
Brand Identity (on its own or as an add-on)$700
Extra pages$250 each
Care Plan: Essential Care$50/month or $550/year
Care Plan: Standard Care$125/month or $1,375/year
Care Plan: Extended Care$250/month or $2,750/year
  • Single-Page Website: Usually ready in about a week, once I have your payment and all your content. It includes one polished homepage written in your voice, a contact section with click-to-call and a short form, your Google Business Profile claimed, verified, and optimized, your Bing listing imported and matched, local search setup (local keywords, service areas, schema markup, AI-search-ready setup), and launch, domain connection, and file handover.
  • Brand Identity ($700) is available on its own or as an add-on to a website project. You get three brand boards to mix and match, then up to two refinements on the direction you choose. You get the finished logo files and the brand board. When it's added to a website, the brand is built first, and the website timeline extends by the time that takes.
  • Extra pages ($250 each) are designed and written in your voice to match your homepage. They aren't sold at booking. We talk first about what the page needs to do, and the page is paid for in full before that work begins.
  • Brand Identity can be added at booking and paid in the same checkout as your website. Any add-on not paid at booking is confirmed in writing and paid in full before that work begins. No add-on work starts unpaid.
  • Email hosting and email accounts are not included in any website package or Care Plan. Anything outside the listed scope (like email systems or ongoing content) isn't included and starts with a conversation. Changes outside the scope are quoted first.
  • Prices are flat. I may change my prices for future orders, but once you've paid, your price won't change for that project.
  • Sales tax may be added where it applies.
  • When your website is finished, I hand it over to you to host in your own accounts, or you can choose a Care Plan and I'll keep it running for you. Domain and hosting costs are yours unless your Care Plan says otherwise.

Payment

  • Your website is paid in full at booking, through Stripe. There's no deposit.
  • You can pay by card, or choose Klarna at checkout to split your payment over time. Klarna financing is an agreement between you and Klarna, under Klarna's terms.
  • Your card must be yours (or you must be authorized to use it), and the details you give must be correct.
  • If a payment is declined, work won't start until payment goes through.
  • I may refuse or cancel an order if I suspect fraud, if there's a pricing or description error, or if I can't take on the project. If I cancel, I'll refund what you paid.

Getting started and timeline

Your project timeline starts once I have your signed contract and all three onboarding items:

  1. Your completed Brand + Business Snapshot
  2. Your intake questionnaire
  3. A short video of your truck, shop, or office

Once I have those, work begins within 48 hours, and your first site proof arrives within 7 days.

  • Delays in sending materials or feedback will push back delivery.
  • I keep the number of projects running at one time limited, to protect quality.
  • All communication and approvals go directly through me. Referral partners can make introductions, but they aren't part of feedback or project management once a project begins.

Cancellations and refunds

  • Before work begins: If you cancel before work begins, you get a full refund. "Work begins" means the first design or setup work, which starts within 48 hours of my receiving your signed contract and all three onboarding items.
  • After work begins: Once work has begun, payment isn't refundable, including if you cancel.
  • Contract not signed: If your contract isn't signed within 14 days of payment, I'll refund your payment minus a $50 administrative fee, and your booking will be released.
  • Onboarding items missing: Your signed contract holds your booking while your onboarding items come in. If any item is still missing 30 days after signing, I may release your booking and refund 50% of what you paid. The other half covers the held booking slot and the administration of the booking.
  • Google Business Profile access: If you don't grant access to your existing profile within 30 days of my first request, the profile optimization is treated as declined. The rest of your project is finished as normal, and no part of the fee is refunded for the declined work.
  • No response: See "If I can't reach you" below.
  • Refund method and timing: Refunds go back to your original payment method through Stripe, usually within about 10 business days. If you paid with Klarna, your refund is handled through Klarna.

Feedback, revisions, and approval

  • Please give focused feedback within two business days at each review stage.
  • Website: Two rounds of revisions are included on your homepage design. A round means you send me one list of changes, and I make them all together. After two rounds, more changes are billed at $75 an hour, and I'll always tell you the estimate before I start. If you'd like ongoing updates, a Care Plan covers them instead.
  • Brand Identity: Up to two refinements on the direction you choose.
  • Additional revisions or scope changes may cost extra. I'll quote them before doing the work.
  • Your site goes live after you confirm approval of the final proof in writing. A reply by email counts.

If I can't reach you

If slow communication or responsiveness stops progress for more than 14 days, I may pause or release your project. Once work has begun, no refund is issued, including when a project is released this way.

Your content and accounts

You're responsible for the text, photos, logos, and other materials you give me (for example, by text message or email). By sending them, you confirm that:

  • You have the right to use them
  • The information in your Snapshot and intake is accurate

You give me permission to use your content only to build and maintain your project. If a claim comes up because of content you supplied, you're responsible for it.

Your domain: I don't buy or hold domains. You keep your domain in your own account at your registrar. To connect your site at launch, you'll give me delegate or admin access to that account. I can fully build your site without it, but it can't go live on your domain until I have access, and any launch delay from missing access extends the timeline. Keeping your domain registered is your responsibility. I recommend turning on auto-renew so it doesn't lapse.

Your Google Business Profile: If you already have one, you'll give me owner access so I can fully optimize it, including its technical setup. You stay the primary owner at all times. Google controls its verification steps, so please complete them promptly when asked.

You own your website

Once your project is fully paid for, you own all the final exported files and your published website.

  • I keep the builder project, working files, design mockups, and templates, unless you've bought them.
  • At launch, you choose one of two paths: your site moves to your own account for you to host and manage, or it stays hosted and maintained by me under a Care Plan. If you move it to your own account, you take over the hosting platform's subscription and fees at that platform's current rates. Either way, the site is yours. I never hold a site hostage. If you host it yourself, I'll walk you through how to manage it and stay on standby if you need me.
  • If you later want full independent control, I'll export your site code and keep your published site live for 30 days from handover.
  • Your site can't fully launch on your domain until you choose a hosting path. If you haven't chosen within 12 months of your site being ready to launch, I may archive the build and remove it from my accounts. You can ask for your site files any time during those 12 months.
  • Third-party items (like fonts, stock photos, plugins, or platform features) stay under their own licenses.
  • I may show your finished project in my portfolio and marketing unless you ask me not to.

Care Plans

Care Plans are available after any DiVita Creative website build. Pay monthly, or prepay for the year and get one month free. No long contracts.

  • Essential Care ($50/month or $550/year): 30 minutes of website edits each month (like rewording a paragraph, swapping a photo, or updating your hours). Hosting and maintenance handled.
  • Standard Care ($125/month or $1,375/year): Everything in Essential, plus a monthly visibility check (rankings glance, listing health, review watch) and a Google Business post every week.
  • Extended Care ($250/month or $2,750/year): Everything in Standard, plus two blog posts a month, page updates, and a citation watch.
  • Every plan includes one person to call when something needs attention.
  • Unused edit time rolls over one month. Older unused time doesn't carry forward.
  • New web pages are $250 each, paid before that work starts.
  • No Care Plan includes email hosting, email accounts, or email writing.
  • Billing: Monthly plans bill each month on the day your plan started, and they renew automatically until you cancel.
  • Cancelling: You can cancel any time by emailing tina@divitacreative.com. Your plan ends at the close of the month (or year) you've already paid for.
  • Refunds: There are no refunds for partial months or for unused months on a yearly plan.
  • If your Care Plan ends, you still own your site, and it moves to your own account for you to host and manage, with the hosting platform's fees paid by you.

Free offers

I sometimes offer free extras, like custom email signatures and website audit recordings.

  • Launch special: a free branded email signature, through December 31, 2026.
  • Free custom email signatures are made by hand and usually ready in 3 to 5 business days.
  • Free website audit recordings are general suggestions, not a guarantee of results.
  • Free tools on the site, like Grade My Website and The Snapshot, give general information only.
  • Free offers may have their own rules, may be limited, and can change or end at any time. If an offer's rules conflict with these terms, the offer's rules apply.

Using my website

Please don't misuse the site. That means no hacking, spamming, scraping, or trying to break it. The site's content, design, and branding belong to DiVita Creative (except content that belongs to others), and you can't use my name, logo, or branding without written permission.

I may suspend or block access to the site for anyone who breaks these terms.

My site may link to other websites. I don't control them and I'm not responsible for their content or practices.

No guarantees

Your website is built to be found, with local keywords, service areas, schema markup, and AI-search-ready structure. I guarantee the quality of my work, not Google's timeline. Rankings and AI recommendations depend on things outside my control, like Google's algorithms, competition, and your review activity. I can't promise specific results like rankings, traffic, or sales.

The site, free tools, and services are provided "as is." To the fullest extent the law allows, I don't make any other promises or warranties.

Limitation of liability

I'm not responsible for hosting interruptions, outages on third-party platforms, or edits you make to your site after launch.

To the fullest extent the law allows:

  • My total liability to you for any claim is limited to the amount you actually paid me for the service involved, or $100 if you haven't bought anything.
  • I'm not liable for indirect or consequential losses, like lost profits, lost data, or business interruption.

Some states don't allow these limits, so they may not all apply to you. In that case, they apply as far as the law allows.

Privacy

My Privacy Policy explains how I handle your personal information. Please read it at https://divitacreative.com/privacy.

Disputes and governing law

If something goes wrong, please contact me first. Most problems can be fixed with a conversation.

These terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts in Monroe County, New York.

The legal fine print

  • If any part of these terms can't be enforced, the rest still applies.
  • If I don't enforce a part of these terms right away, I can still enforce it later.
  • If these terms are ever translated, the English version controls.

Changes to these terms

I may update these terms from time to time. I'll post the new version here and change the "Last updated" date. For big changes, I'll try to give at least 30 days' notice before they take effect. Changes won't affect projects you've already paid for. If you keep using the site or services after changes take effect, you accept the new terms.
